Official Contest Rules
FOR PERSONS WHO ENTER THE CONTEST THROUGH OUR WEB SITE AT WWW.BACKROADS.COM, THESE RULES GOVERN ALL ASPECTS OF PARTICIPATION AND PRIZE AWARD. NO PURCHASE NECESSARY TO ENTER OR WIN
The Prize is sponsored by Backroads. One (1) winner will be selected based on eligible votes. Void where prohibited.
The Contest begins January 13th, 2014 at 12:00 a.m. PST and ends February 13th, 2014 at 11:59 p.m. PST ("Promotion Period").
This Contest is offered only electronically via the Internet. Employees of Backroads and household members of each such employee are not eligible to enter. By participating, entrant agrees to abide by these Official Rules and the decisions of Backroads, which are final and binding in all respects.
One (1) Grand Prize in the form of a $200 Patagonia gift card will be awarded.
5. How to Enter the Contest
Go to http://www.backroads.com/photo_voting
and follow the instructions for entry. After you have submitted the required information, you will receive one (1) entry into the Contest. For all entries: LIMIT: One (1) entry per person. All online entries must be received during the Promotion Period. Use of any automated system to submit entries is prohibited and will result in disqualification. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the authorized account holder.
6. How to Vote
LIMIT ONE (1) ENTRY PER PERSON. Only one entry is allowed and any subsequent attempts to enter will disqualify that person. The submission of an entry is solely the responsibility of the entrant. Automated entries (including but not limited to entries submitted using any bot, script, macro, or contest service), copies, third party entries, facsimiles and/or mechanical reproductions are not permitted and will be disqualified. Only eligible entries actually received by Backroads before the end of the specified entry period will be included in the voting. Unintelligible, incomplete, or garbled entries will be disqualified. All entries become the property of Backroads. Voters with nonvalid e-mail addresses, returned e-mail addresses, refusing e-mails, or unsubscribing from our contest will have their votes disqualified. Use of multiple e-mail accounts is not allowed.
7. Potential Winner
On February 14th, 2014, Backroads will announce the potential winner from among all eligible entries. Entrant selected must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. The potential winner will be notified by e-mail or phone within ten (10) days of the announcement. Except where prohibited, potential winner must sign and return to Backroads, within ten (10) days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If the potential winner cannot be contacted within ten (10) days of the first attempt to contact him/her or if he/she fails to sign and return the affidavit of eligibility and liability/publicity release within the required time period, an alternate entrant will be selected in his/her place from among all eligible entries received.
Participation in the Contest constitutes winner's consent to Backroads' use of winner's name, hometown and state or province for promotional purposes in any media without further payment or consideration.
9. General Conditions
Backroads reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Backroads' reasonable control impairs the integrity of the Contest, as determined by Backroads in its sole discretion. In such event, Backroads reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment.
By receipt of any Contest prize, winner agrees to release and hold harmless Backroads, its respective affiliates and related companies, and each of its and their respective officers, directors, employees and agents from and against any claim or cause of action arising out of participation in the Contest or receipt or use of any prize.
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Backroads that corrupts, impairs or affects the administration, security, fairness, integrity, or proper conduct of this Contest, Backroads reserves the right, at its sole discretion, to cancel, terminate, modify, extend or suspend the Contest and/or prizes. In such event, Backroads may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Backroads further reserves the right to disqualify any individual who tampers with or in any way corrupts the entry process. Backroads may prohibit an entrant from participating in the Contest or winning a prize if, in Backroads' sole discretion, Backroads determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Backroads representatives.
12. Limitations of Liability
Backroads is not responsible for: (1) incorrect or inaccurate transcription of entry information or late, lost, incomplete, misdirected entries, or entries received through impermissible or illegitimate channels, all of which will be disqualified; (2) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer, network, hardware or software; (3) the unavailability or inaccessibility of any service; (4) unauthorized human intervention in any part of the entry process or the Contest; (5) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (6) any injury or damage to persons or property, including but not limited to entrant's computer, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or from downloading any material from Backroads' Web site, regardless of whether the material was prepared by Backroads or a third party, and regardless of whether the material is connected to Backroads' Web site by a hypertext link.
Entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prizes awarded shall be settled by binding arbitration in San Francisco, California pursuant to the then existent commercial rules of the American Arbitration Association. In any such arbitration, the substantive but not procedural rules of California will apply without regard to the California Arbitration Act, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no event will attorneys' fees punitive, incidental and/or consequential damages be awarded.

16. Use of Contest Entries / Contact Information
By entering the Contest, each participant acknowledges Backroads right to use submitted pictures for future marketing activities. Backroads owns all rights to the photographs and pictures will not be returned.
By entering the Contest, each participant acknowledges having read these rules and regulations and agrees to be bound by them and all decisions of Backroads, which shall be final.
